DECISION
by the Director of Port Authority of Danang
issuing the "Quangnam - Danang Sea-Port Regulations".

THE DIRECTOR
of Port Authority of Danang.

  • On the basis of Decision No. 158/QD-TCCB-LD dated 24 December 1992 by Vietnam National Maritime Bureau the establishment of Port Authority of Danang;
  • On the basis of Article 59 - Vietnamese Maritime Code;
  • On the basis of Article 4 of "the Regulations on the Management of Maritime Shipping Activities at Sea-Ports and in the Maritime Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February, 1993 by the Government of the Socialist Republic of Vietnam;
  • On the basis of the official Correspondence No. 198/PC dated 4 August 1995 by the Vietnam National Maritime Bureau on approval for the Director of the Port Authority of Danang to issue "Quangnam - Danang Sea-Port Regulations";
  • Considering the actual situation; aiming to enhance the effectiveness State - management on Maritime section within Quangnam -Danang Sea-Port waters;
  • At the proposal of Maritime Legal Department of the Port Authority of Danang;

DECIDES

Article 1:
Hereby issuing, together with this Decision, "Quangnam - Danang Sea-Port Regulations".

Article 2:
The present decision enters into force on the 1st of October 1995, and shall govern all organizations and individuals operating within Quangnam-Danang SeaPort waters.
All of the previous provisions contrary to the present decision are hereby repealed.

Article 3:
The heads of the departments: Maritime Legal, Maritime Safety Investigation of Port Authority of Danang, other related departments, and the subjects mentioned in Article 2 take responsibility for implementing the present decision.

QUANGNAM - DANANG SEA-PORT REGULATIONS
(Issued with Decision No. 56/QD-PCCV
dated August 10th, 1994 by the Director of
the Port Authority of Danang)


Chapter I
GENERAL PROVISIONS

Article 1:
The present Regulations particularly stipulated for the rules of maritime activities in the Quangnam-Danang Seaport waters, which are made on the basis of "the Regulations on the Management of Shipping Activities at seaports and in the marine navigable zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government in order to assure maritime safety, sanitation-security, environment pollution prevention.

Article 2:
1. The provisions of the present Regulations and other relevant existing legal documents are compulsory for every local or foreign organizations and individuals having waterway means of transport operating within the Quangnam-Danang seaport waters.
2. Nobody, irrespective of lack of knowledge of the present regulations, is exempted from liability.
Any infringement of the provisions stipulated in the present regulations shall be dealt with to the extent proposed in "the Regulations on the Management of Maritime Activities at Sea-Ports and in the Marine Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25 February 1994 by the Government.

Article 3:
The Quangnam-Danang Sea-Port waters comprises:
1. Danang Sea-Port waters:
a. The waters in front of berths, wharves belonging to the port enterprises situated in the Danang SeaPort area.
b. The port entrances and exits fairways, the sea-going shipyards and the areas for anchorage and lighterage, storm-avoiding at Danang bay and Han river channel
2. Ky Ha Sea-Port waters:
The waters in front of berths, and waters in the channel lanes from pilot station area to the waters in front of Ky Ha port.

Chapter II
SPECIFIC PROVISIONS

Section A: Entering and leaving Ports.

Article 4:
The foreign vessels which are already granted the port entrance /exit permits by the Vietnam National Maritime Bureau, before entering Danang Sea-Port waters, those papers shall be submitted to the Port Authority of Danang no later than six (6) hours before the expected time for the ship to arrive at the pilot station.
For ships/vessels with capacity of more than 200 GRT, on entering ports, if there is any incident or abnormal operations of ship's main engine, steering, anchoring gear, hull; then apart from observance of the provisions therein Article 17 of "the Regulations on the Management of Shipping Activities at Sea-Port and in the Marine Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government, the shipmaster shall notify Director of Port Authority of Danang in details of such above-mentioned happenings and the relevant requirements.

Article 5:
Vietnam ships of less than 200 GRT having inland course, on arriving at the "zero buoy", use means of communications or cooperate with DANANG RADIO to contact and strictly obey the instructions from the Port Authority of Danang, while navigating in the fairways.
Within twenty-four (24) hours as from time the ship safely anchors at the position provided by the Port Authority of Danang, the shipmaster or his authorised representatives shall obtain entrance procedures at the Standing Board of the Port Authority of Danang.

Article 6:
Foreign ships or Vietnam ships back to Quangnam-Danang Sea-Port waters from oversea, on arriving at the "zero buoy", use means of communications to contact the Port Authority of Danang for anchorage position and ship's necessary entrance procedures.
Any change in position of ships as stipulated, if any, shall be approved by the Port Authority of Danang.

Article 7:
No later than four (4) hours before ships leave the ports, shipmasters shall submit entrance application (in the form No. 92), application for pilot (if any as per regulations) at the Standing Board of the Port Authority of Danang and other licenses which have been obtained using during the time of operation in the port, all to the specialised authorities.

Section B: Communications

Article 8:
All vessels on entering / leaving ports and during their operating time in the Danang Sea-Port waters shall constantly keep communications with the Port Authority of Danang by VHF on the following channels:
- Channels 16 (156,800 MHz) for general contact;
- Channels 13 (156,650 MHz) for working contact.
Besides, communications with the Port Authority of Danang may be made (through DANANG RADIO or DANANG TELECOM) by:

Section C: Pilotage and Auxiliary tugboat rules

I-Pilotage rules.

Article 9:
1. For Vietnam dry-cargo ships of GRT from 1000 to 2000, if the shipmasters own marine pilotage certificates appropriate to the ships class and piloting area in which the ships are operating, and are capable of undertaking the safe piloting personally, then the Director of the Port Authority of Danang, after considering the actual situations and other maritime safety qualifications therein, may allow them to navigate personally their ships in the channel lane from pilot station to the ports within Quangnam-Danang Sea-Port waters and the vice versa.
2. Vessels of from 600 GRT to 1000 GRT carrying oil, petrol or other flammable substances, when operating on the channel, mooring / leaving berths or buoys, shall employ pilots and pay for relevant pilotage fees as provided for in existing regulations.
By considering other safety standards of such these vessels and so far as practicable, the Director of the Port Authority of Danang may allow to pilotage exempt.

Article 10:
1. During the pilotage of ships/vessels, the pilots are obliged to immediately notify the Director of the Port Authority of Danang by means of communications of the following matters:
- Any maritime unsafety situation or risk within Quangnam-Danang SeaPort waters.
- Sea environmental pollution situation which they have seen.
- Reason for any delay in pilotage in comparison with the manoeuvring schedule of the Port Authority of Danang.
2. While piloting the vessel, if there is any maritime incident of the vessel, the pilot shall make a written report and send it to the Director of the Port Authority of Danang within twenty four hours of the ending of pilotage duty.
3. Every thirty (30) minutes during piloting until the pilotage duty is completed, pilots are obliged to inform the Port Authority of Danang about the pilotage by means of communications as stipulated.

II-Auxiliary tugboat.

Article 11:
Tugboat service employment are compulsory to all sea-going ships of 70 metres or more in length, when maneuvering for berthing, unberthing, turning in Quangnam-Danang sea-port waters or ships navigating on the narrow lanes of the sea-port waters.

Article 12:
In normal weather conditions, tugboat service employment is stipulated as follows:
1. For each vessel of 70 metres to 120 metres in length, one tugboat having power of no less than 500 HP (375 KW) is required.
2. For each vessel of 121 metres to 140 metres in length, two tugboats, one of which having power from 1000HP (750 KW) or more and the other having power from 800HP (600KW) or more are required.
3. For each vessel of 141 metres to 175 metres in length, at least two tugboats, each of which having power from 1200HP (900 KW) or more are required.
4. For each vessel of 175 metres to 300 metres in length, at least four tugboats, each of which having power from 1200HP (900 KW) or more are required.
5. For each vessel of 301 metres or more in length operating in Ky Ha Sea-Port waters, at least six tugboats, each of which having power from 1200HP (900 KW) or more are required.
6. If the vessels aforesaid in Item 1 and 2 are fitted with fore and franking propellers, then the shipmaster may request the Director of the Port Authority of Danang for exemption of tugboat service.

Article 13:
In the abnormal weather conditions (Wind-force from five (5) beaufort scale or more, or high-flood etc.) tugboat service employment is particularly provided for by the Director of the Port Authority of Danang, on the basis of increase of the quantity and capacity of tugboat referred to in Article 12.

Article 14:
For each vessel of high draught, more than 141 metres in length or more than 12,000 DWT in tonnage, manoeuvring to turn or enter / leave ports, buoys or navigating on the channel, the Director of the Port Authority of Danang has to right to order or the shipmaster may request to increase auxiliary tugboat service both in quantity and capacity in comparison with the provisions prescribed in Item 3, Item 4, Item 5-Article 12 of the present Regulations.

Section D: Maritime Operation in the Sea-Port waters

Article 15:
All ships/vessels operating within Quangnam-Danang Sea-Port waters shall strictly exercise all of instructions of the Port Authority of Danang.
All ships/vessels, when navigating on the entrance/exit channel, buoys and anchoring areas, shall keep a proper safe speed, not exceeding four (4) knots.

Article 16:
1. The anchorage of ships/vessels on the passage from light-buoy No. 1 to the end of Nam-Bac dam is prohibited.
In case any maritime incident occurred on this passage that causes the ship unmovable, then the shipmaster , by any possible way, shall communicate with the Port Authority of Danang for a timely treatment.
2. Ships/vessels of more than seventy (70) metres in length shall not take over other on the passage from light-buoy No. 1 to Nguyen Van Troi bridge-area.

Article 17:
1. For vessels not carrying explosive or noxious goods, oil or other flammable substances, the anchoring / berthing co-ordinates are designated as the following:
- At Danang bay: From Area No. 1 to Area No. 42 (see the attached Appendix II).
- On Han River: Passage from Han Bridge No. 1 to Han Bridge No. 9, which is limited by the two point with the co-ordinates as follows:

The anchorage positions are stipulated on the left side of Han River, alongside the channel corridor.
2. The anchoring / berthing co-ordinates for tankers and flammable substances carriers are designated as the following:
- At Danang bay: Point A, B, C (see the Appendix II)
- Lien Chieu buoy

For tankers of less than 3000 GRT, depending on actual conditions, the Director of the Port Authority of Danang shall stipulate the position and time permitted to anchor accordingly in other several specific positions within Han river area.
3. For foreign ships/vessels entering Quangnam-Danang area to have holds cleaned and fumigated, the Director of the Port Authority of Danang shall designate the particular anchorage position on the basis of the following conditions:
- The type of the ship;
- The kind of goods previously carried by the ship;
- Weather conditions when the ship arrived.

Article 18:
For explosive or noxious substances carriers, the Director of the Port Authority of Danang shall so far as practicable provide the anchorage or mooring position appropriate to cargo handling .
During and on the process of operating to load/unload the aforesaid cargo, ships and relevant port enterprises take responsibility to strictly comply with the existing regulations on safety prescribed by the State.

Article 19:
When leaving / entering berths, buoys or navigating on the channel or anchoring at anchorage areas, oil tankers, other flammable, explosive and noxious carriers shall:
- Put up a "B" flag (Bravo) at the best-to-be-seen position in day time.
- Display a red light in night time, at the positions visible from all directions with the least shining range of two nautical miles.

Article 20:
Regarding to ships of armed-force on duty of goods carriage for military purpose, the shipmasters, prior to go through the Sea-Port waters or the main channels of the regional ports of Danang to enter berths, wharves in the military area, are obliged to inform to the Director of the Port Authority of Danang in order that maritime safety and fire and explosion prevention in the Sea-Port waters shall be examined and assured.
The above mentioned vessels shall not anchor, berth or moor at commercial ports, Han river channel and fairways, unless a permit will be obtained from the Director of the Port Authority of Danang.
Transport operations for economic purpose shall be under the survey, examination and management of the Port Authority of Danang, and shall comply with the Regulations accordingly and other existing relevant rules of the State.

Article 21:
Vessels carrying oversize, overweight, or bulky cargo or floating cranes, when navigating, or at berths or at anchorage for cargo handling, shall:
- Put up two flags "R" and "Y" (Romeo and Yankee) in day time;
- And two lights red and blue with the least shining range of two nautical miles in night time, displayed vertically the red above the blue (the distance from each other is two (2) miles) at an all-round visible location.
The helmsmen of other means of water transportation shall have due regard and navigate at the proper speed so as not to endanger them.

Article 22:
By receipt of "Notice of monsoon" or "Warning of Storm" thereupon, shipmasters shall draw cautions in such special way that main engines of the ships are in readiness to request for a permit if necessary, or under manoeuvring order of the port authority of Danang to move to storm-avoiding anchorage area.
In case of "Maritime distress order", all of involving people, all of existing ships within the port area are obliged to abide every order or requirement issued by the Director of the Port Authority of Danang in engaging in aid actions of ships or people being in distress.

Article 23:
1. Within the sea-port area, ships are permitted to moor one another as per the following provisions:
a. At the berths of Tien Sa port and Ky Ha port area; ships can moor each other by twos at maximum, except for in abnormal weather conditions.
b. At the berths of Han river from No. 01 to No. 06; ships of not more than 2000 GRT, can moor each other by twos.
c. At the berths of Han river from No. 7, 8, 9 and the berth of Enterprise No. 234; ships of not more than 600 GRT, can moor one another by threes.
Ships from 601 GRT up to 1000 GRT can moor each other by twos.
2. Regarding to mooring one another of ships, shipmasters, besides observing the provisions prescribed in Article 35 of the Regulations on the Management of Maritime Activities at Sea-Ports and in the Maritime Navigable Zones of Vietnam, shall appropriately comply with the principle, that is: Ships of larger size shall not moor ships of smaller size from the outside; and fenders shall be located to the standards between the ships.
3. Any ship shall apply to the Port Authority of Danang for a permit to moor.

Article 24:
In the Danang Sea-Port waters, the berthed or anchored vessels, prior to proceed repair work such as hammering, painting, welding, cutting or repair of main engine or steering, anchoring motor boat to exercise, examine or maintain ships, or pumping water from ships etc. a permit from the Port Authority of Danang shall be obtained.
The application for this permit shall be a detailed description of the items to be repaired, the time required for such work and the repairer's qualifications. In case of application for testing ships, the items shall include the following: the list of the attendants on the ship during testing, commitment on life-buoys to assure safety of the attendants, passage and time to test engine and capacity, licenses and certificates (copies) of the shipmaster, and the chief engineer.

Section E: Regulations on Sanitation.

Article 25:
Any action that may affect maritime safety in the fairways and ships' navigation lanes is strictly forbidden.
Fishing ships shall not anchor or berth in the passage of fairways, and in Han river channel from light-buoy No. 1 to Nguyen Van Troi bridge area and the port side of Han river ( of the Area No. I)
Fishing ships of any types are permitted to anchor or berth out of the fairways closely to the port side of Han river (of the Area No. III) provided that the anchorage or berthing shall not obstruct the anchorage, navigation or turning in the area of other ships.

Article 26:
The placing of fishing traps/nets and any other ways of catching marine products in the entire channel fairways and navigating lanes, which are limited in the following particular areas are strictly prohibited:
1. The anchorage areas at Danang bay and My Khe bay.
2. At Danang SeaPort waters from light-buoy No. 1 to Nguyen Van Troi bridge area.
3. At Ky Ha port area:
From pilotage station area with co-ordinates of j : 15o29.5N and l : 108o41.7E and alongside the fairway to the interfaced waters of the port (including the turning area in front of the berth).
4. The lane and fairway to Hai Son port (X50).
The aforesaid activities in the remaining areas of Danang Sea-Port waters shall observe the regulations mentioned in Item 2, Article 47 of "The Regulations on the Management of Shipping Activities at Sea-Ports and in the Marine Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government.

Article 27:
In the meanwhile of ships of all kinds navigating within the Quangnam-Danang Sea-Port waters, shipmasters shall obey the provisions stipulated in Article 44 of "The Regulations on the Management of Shipping Activities at Sea-Ports and in the Marine Navigable Zones of Vietnam" and have regards to the following notes:
- Not to make any sound or light signals other than those stipulated in the rules.
- To timely stop steering and execute the instructions from the Port Authority of Danang so far as practicable to ensure maritime safety, prevent against environmental pollution and fires and explosions or to conduct activities for other ships and life aid purpose.

Article 28:
Organizations intending to hold military marches, sport games or crowed demonstrations within the Port waters shall make an application to the Port Authority of Danang.
Upon a permit by the Director of the Port Authority the aforesaid activities shall be conducted.

Article 29:
Prior to commencement of any construction project within the Quangnam-Danang Sea-Port waters, the investors shall submit the permit granted by the Vietnam National Maritime Bureau to the Port Authority of Danang, and in the mean time, shall file a copy of documents of the project to be carried out so that the Port Authority of Danang, in cooperation with the relevant authorities, could supervise the conditions of maritime safety, sea environmental pollution prevention, fire and explosion extinguishing safety of the works.

Article 30:
Shooting of rubbish and garbage of ships operating in Danang SeaPort waters is specifically regulated as follows:
1. For passenger-ships: At least once per day.
2. Other cargo ships of any types: At least once every two days.
In addition, if shipmasters request, rubbish and garbage can be shot in an earlier time.
In case it is in need of letting stipulated wastes out of the ships, the shipmasters shall apply to the Port Authority of Danang for a permit to implement the work.

Article 31:
Enterprises engaged in wastes collecting service shall be well equipped with means of carriage, equipment and areas specialised in collecting and disposing rubbish, wastes and dirty water of ships etc. in conformity with sanitation and environment protection rules.

Article 32:
Stations of sand and gravel for construction located alongside the channel of Han river shall regularly embellish and consolidate the bend-guard system, the height of which shall be kept one (1) metre and up higher than the highest level of tide is. Sand and gravel shall be kept not overflowing into the river and raising the channel.

Article 33:
Production, Trade or Service units posited alongside the channel of Han river; the organizations owning berths and stations exclusive of receiving seafood carriers shall not let out indisposed dirty and wasted water, oil sludge, rubbish and garbage, wastes and residuals etc. produced throughout the process of production and operation into Han river.

Section F: Prevention of Fire, Explosions
and Environmental Pollution from Ships.

Article 34:
During the time the ship is loading / unloading flammable or explosive cargo at the wharves, the shipmaster shall request to have a fire-fighting station or fire-engine standing -by at the ship's side and he is liable for the payment of the costs incurred.
Article 35:
Tankers, while lying at wharves for delivering or receiving oil, petrol, oil products or other flammable substances shall observe the following stipulations:
1. Not to lie at anchor, where as to have ready all her qualified fires and explosions-fighting at the proper place for the response to an emergency.
2. Pay out a solid steel cable from the bow and the other from the stern with appropriate length of each, the loop end one metre (01)m above the surface of water for emergency towing.
3. Not to have main engine, steering or anchorage engine repaired during the lay time.
4. In case of towed non-propelled team of ships, a tugboat shall be in readiness for duty.

Article 36:
During the time a foreign ship entering Danang waters to have oil-holds/hatches cleaned, the shipmaster shall request for a fire-fighting station or fire-engine standing -by on the ship and bear the costs incurred as provided for by the existing rules.
Mooring of the aforesaid ships to get oil sludge, or move equipment and service men shall be examined and permitted by the Port Authority of Danang.

Article 37:
Ships, while mooring at berths, are prohibited from carrying on the deratting or other fumigation work, unless they are permitted to and located at the exact anchoring positions by the Port Authority of Danang.
During the mean time of work, ships shall display the correspondent warning signals to be easily in sight; as well as shall take measures to prevent against environmental pollution around the ships.

Section G: Responsibilities of Port Enterprises.

Article 38:
The enterprises, which own berths and wharves in Quangnam-Danang SeaPort waters, shall fully and diligently perform the following provisions:
1. To maintain safe standards so far as practicable for ships entering / leaving, berthing or cargo - handling, which includes: quantity of fenders appropriate not to endanger ships and berths; solid stakes being painted in stipulated colours; berths and wharves to fit with the standards of the technical planning, to supply full light-shining in night time; the depths of the piers and interfaced waters of berths and wharves to be maintained appropriate to the latest altitude provided for to the Port Authority of Danang.
2. The port enterprises are responsible for surveying the depth of the piers and interfaced waters of berths and wharves and submit the altitude to the Port Authority every six (6) months.
3. The port enterprises take responsibility to co-operate with the Port Authority of Danang and the local specialised and responsible agency of fires and explosions extinguishing in making plan for fires and explosions prevention appropriate to assure the port-area safety.

Article 39:
Units having berths and wharves, buoys exclusive of oil and petrol exchange; units having docks, floating yards; units demolishing ships; units performing oil tankers cleaning service etc. shall equip berths, wharves, stations and warehouses where on with fires and explosions extinguishing and environmental pollution prevention facilities which include: fire-extinguishers, oil booms and chemicals, oil filter equipment, oil sludge and wastes tanks, measurement equipment of oil strength in water etc. These facilities, of which the effectiveness shall be conformed to the provided standards, shall be placed at proper locations and in a state of readiness for response to an incident.
For berths and wharves used as passenger stations, the management, employment units of those are responsible for work out an "Regulations on passenger-berths" to observe.
The Director of the Port Authority of Danang shall consider to locate the places of berthing, cargo handling and passenger delivery/reception on the basis of the follows:
a. Maritime safety conditions of ships, berth and stations to be assured.
b. The actual demand of ship-owners or cargo-owners a place for cargo handling or passenger delivery/reception.
c. The demand and possibility of the enterprises having berths, stations for cargo handling or passenger delivery/reception.
d. Security and environmental sanitation of the berth, station areas to be kept well.

Article 40:
1. From 7a.m. to 8 a.m. everyday, the port enterprises shall:
- Report to the Port Authority of Danang (by telephone No. 23172) on: the situation of operating and cargo handling of ships at their wharves, berths, stations or buoys.
- Submit the Port Authority of Danang the plan for manoeuvring and arranging ships within the wharves, berths, stations or buoys in order to make the employment schedule better for their production and operation to be settled timely.
2. Provided that the Port Authority of Danang shall be notified to examine and manage, the port enterprises are permitted to conduct by themselves in case of navigation of ships limited in a berth area without the employment of the ship's main engines nor tow boats.

Chapter III
IMPLEMENTATION PROVISION

Article 41:
The present regulation shall take effect from October the 1st 1995.

Article 42:
All the previous regulations of the Port Authority of Danang, which are contrary to this Regulation, are now annulled.
