Safe speed for navigation !

Ships of all kinds, while navigating in the sea-port or fairways to and from the anchorages , must resort to the proper speed to assure general safety. In the narrow channel lanes hereafter mentioned, the ship's speeds are concretely stipulated as follows:
- From Eastern Dinh Vu canal to Vatcach port, not exceeding four (4) knots.
- From Eastern Dinh Vu canal to Pharung ship yard, not exceeding six (6) knots
- Vessels of 130 metres or more in length must not overtake one another in the channel lane from Eastern Dinhvu canal to Vatcach port.

DECISION
by the Director of Port Authority of Haiphong
issuing the "Haiphong Sea-Port Regulations"

THE DIRECTOR
of Port Authority of Haiphong.

  • On the basis of Decision No. 598/QD-TCCB-LD dated 6th April, 1991 by the Ministry of Transport, Communications-Post on the establishment of Port Authority of Haiphong.
  • On the basis of Decision No. 2349/QD-TCCB-LD dated 20th November, 1991 by the Minister of the Ministry of Transport, Communications-Post on promulgating the provisional regulations on the organization and activities of Port Authority.
  • On the basis of Article 4 of "the Regulations on the Management of Maritime Shipping Activities at Sea-Ports and in the Maritime Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February, 1993 by the Government of the Socialist Republic of Vietnam.
  • On the basis of the official Correspondence No. 2123/PC dated 16th December, 1994 by the Vietnam National Maritime Bureau on issuing "Haiphong Sea-Port Regulations".

DECIDES

Article 1:
Issuing, together with this Decision, "Haiphong Sea-Port Regulations".

Article 2:
The present decision enters into force on the 1st of January 1993, all the previous provisions contrary to the present decision are hereby repealed.

Article 3:
The organizations or individuals owning means of water transportation or conducting any activity relating to or in the Haiphong Sea-Port waters, and the heads of the related sections of Port Authority of Haiphong must take responsibility for implementing the present decision.

HAIPHONG SEA-PORT REGULATIONS
(Issued with Decision No. 186/QD-PTATHH
dated December 21st, 1994 by the Director of
Port Authority of Haiphong)


CHAPTER I
GENERAL PROVISIONS

Article 1:
The present Regulations particularly stipulated for the rules of maritime shipping activities in the Haiphong Sea-Port waters and its adjacent areas, which are made on the basis of "the Regulations on the Management of maritime shipping activities ar sea-ports and in the marine navigable zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government.

Article 2:
1. The provisions of the present Regulations are compulsory for every individual, every sea-going ship as well as other means of water transport operating within the Haiphong sea-port waters.
The Haiphong Sea-Port waters comprises: the waters in front of berths, wharves belonging to the port enterprises situated in the Haiphong Sea-Port area, the port entrances and exits fairways, the sea-going shipyards and the areas for anchorage and lighterage (details referred to in Appendices I & II).
2. Nobody, irrespective of lack of knowledge of the present regulations and other relevant existing laws and regulations, is exempted from liability.

CHAPTER II
SPECIFIC PROVISIONS

Section A: Entering and leaving Ports.

Article 3:
The foreign vessels which are already granted the port entrance /exit permits by the Vietnam National Maritime Bureau, before entering Haiphong Sea-Port waters, those papers must be submitted to the Procedures Section of the Port Authority of Haiphong by the shipowner or shipowner's representative or ship's agent.

Article 4:
On entering ports, if there is any incident or abnormal operations of ship's main engine, steering, anchoring gear, hull; then apart from the telegrams made as stipulated in Article 17 of "the Regulations on the Management of Maritime Shipping Activities at Sea-Port and in the Marine Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government, the shipmaster must notify Port Authority of Haiphong of such above-mentioned happenings.

Article 5:
Sea-going ships may enter and leave Haiphong sea-ports around-the-clock, however, the ships with restricted draught will be permitted to enter and leave the ports by the Port Authority of Haiphong according to the tide.

Article 6:
Though, Vietnam ships of less than 200 GRT, when entering the ports, do not have to stop at the pilot station, the shipmasters shall, on arriving at the "zero buoy", communicate with and strictly obey the instructions from the Port Authority of Haiphong while navigating in the fairways. In case of unsafety of the fairways, ships must come to anchors at the pilot station awaiting orders from the Port Authority of Haiphong.

Article 7:
In the case of a ship already granted the Port Clearance, but failing to depart on schedule, the shipmaster shall timely notify the Port Authority of Haiphong and re-apply to exit.

Section B: Communications

Article 8:
All vessels on entering / leaving ports and during their operating time in the Haiphong Sea-Port waters must costantly keep communications with the Port Authority of Haiphong by VHF on the following channels:
- Channels 16 for general contact.
- Channels 10 and 06 for working contact.
Besides, communications with the Port Authority of Haiphong may be made by:

Article 9:
All vessels, while anchoring or berthing within Haiphong Sea-Port waters must constantly keep communications with the Port Authority of Haiphong by the means of communications as mentioned in Article 8. For the VHF contact, daily, at the first ten minutes of every receive information from the Port Authority of Haiphong and the vice versa.

Section C: Pilotage Rules.

Article 10:
1. For Vietnam ships of GRT from 1000 to 2000, if the shipmasters are capable of undertaking the safe piloting personally, then the Director of the Port Authority of Haiphong, after considering the actual situations may allow them to navigate personally their ships in the channel lane from pilot station to Bachdang anchorage and the vice versa.
2. If the shipmasters of Vietnam sea-going ships have the maritime pilotage certificates and the appropriate regional maritime pilotage license, they, after being approved by the Director of the Port Authority of Haiphong, may navigate personally their ships on leaving and entering ports in the Haiphong Sea-Port waters.

Article 11:
1. Within the Haiphong Sea-Port waters, the pilots are obliged to immediately notify the Director of the Port Authority of Haiphong by VHF or in writing of any maritime unsafety or environmental pollution risks which they have seen while piloting vessels.
2. While piloting the vessel, if there is any maritime incident of the vessel, the pilot must make a writing report and send it to the Director of the Port Authority of Haiphong within twenty four hours of its occurance.

Section D: Navigating in the Sea-Port waters.

Article 12:
Prior to the ship's maneuvers or shiftings, the ship's equipment such as derricks, gangways, life-boats as well as the others must be placed into the rests and firmly tied up.

Article 13:
1. For the vessels carrying explosive or noxious goods, the Director of the Port Authority of Haiphong, depending on each particular case, will designate either the anchoring position or berthing at Doanxa port or the other appropriate wharf for the cargo handling work. In any case, the shipmasters together with the managers of port enterprises must strictly exercise the provisions on minimum safety distances between ships as well as the other existing safety regulations.
2. The anchoring / berthing positions for oil tankers and flammable substances carriers are designated as the following:
- Thuongly wharf.
- Trabau No. 4 position at coordinates:
Lat. = 20049'12''N; Long. = 107005'18'' E.
- Trabau No. 5 position at coordinates:
Lat. = 20049'18''N; Long. = 107006'12'' E.
3. When leaving / entering Sea-Port or anchoring at anchorage areas, the tankers, carriers mentioned in paragraphs 1 and 2 must put up a "B" flag (Bravo) in day time and a red light in night time, displayed at the positions visible from all directions with the least shining range of two nautical miles.
The helmsmen of other means of water transportation, when approaching those above mentioned vessels, must pay the particular and appropriate attention.

Article 14:
Vessels carrying oversize, overweight, or bulky cargo or floating cranes, when navigating, or at berths or at anchorages for cargo handling, must put up two flags "R" and "Y" (Romeo and Yankee) in day time and two lights with the least shining range of two nautical miles in night time, displayed vertically the red above the blue at the most visible location.
The helmsmen of other means of water transportation must pay attention to and navigate at the proper speed so as not to endanger them.

Article 15:
Every means of water transportation, while anchoring or berthing within the Haiphong Sea-Port waters, have to not make any sound or light signals other than those stipulated in the existing International Regulations for Preventing Collision at Sea 1972 or for emergency or for testing the pertaining repaired equipment as noted in the permit of the Port Authority of Haiphong.

Article 16:
Every ship, while navigating in the Haiphong Sea-Port waters must immediately stop or maneuver at the orders from the Port Authority of Haiphong.

Article 17:
Ships of all kinds, while navigating in the sea-port or fairways to and from the anchorages , must resort to the proper speed to assure general safety. In the narrow channel lanes hereafter mentioned, the ship's speeds are concretely stipulated as follows:
- From Eastern Dinh Vu canal to Vatcach port, not exceeding four (4) knots.
- From Eastern Dinh Vu canal to Pharung ship yard, not exceeding six (6) knots
- Vessels of 130 metres or more in length must not overtake one another in the channel lane from Eastern Dinhvu canal to Vatcach port.

Article 18:
Ships and other means of water transportation are prohibited from lying at anchor in the channel lane from Eastern Dinhvu canal to Benbinh ferry, except for those either having incident of her steering gear, her main engine or being ordered by the Port Authority of Haiphong. In the case of being conpulsory to drop anchor in the aforenamed channel lanes, the shipmaster must immediately notify the Port Authority of Haiphong of the ship's anchoring position and the reasons for such activities.

Article 19:
1. During the three hours' time before and the two hours' time after the hours of highest tide level at Hondau (according to the Tide Tables issued by the Hydrometeorological Service), towage teams must obey the following stipulations:
- Towage teams (pulling / pushing or alongside towing) must not go through by the Dinhvu canal).
- Towage teams going from CuaCam port to the Bachdang river must keep close to the Thuynguyen side as safe as possible, then, follow Ruotlon river lane to the Bachdang river.
- Towage teams going from Namtrieu estuary or from Trap canal or from the Bachdang river into the Cam river must lie at anchor awaiting at the area close to the Nhamac field edge, upstream wards of the Bachdang river, or, if they do not wish to drop anchor awaiting, they may proceed along Ruotlon river lane, but, on approaching the confluence at the western Vangchau lighthouse, they must keep close to the Thuynguyen side in the appropriate safe distance.
2. The maritime warning devices forbidding towage teams from going through in the channel lanes, as mentioned in paragraph 1 of this Article are located at the Dinhvu lighthouse area (in the Haiphong side) with the warning signals (details referred to appendix III).
+ In day time:
Two vertically opposite triangles arranged above a round shape, all in black colour.
+ In night time:
Tree lights arranged vertically, the green at the top, the white in the middle, the red at the lowest.

Article 20:
Prior to commencement of any construction project within the Haiphong Sea-Port waters, the investor, besides observing the regulations mentioned in Article 7 of "The Regulations on the Management of Maritime Shipping Activities at Sea-Ports and in the Marine Navigable Zones of Vietnam" promulgated with Decree No. 13/CP dated 25th February 1994 by the Government, must submit the permit granted by the the Vietnam National Maritime Bureau to the Port Authority of Haiphong.

Article 21:
Any activity that may endanger marine navigation safety in the fairways and passages for sea-going ships is strictly prohibited. Especially, the catching of marine products in the channel lane from DInhvu canal to Benbinh ferry is strictly prohibited. In the remaining parts of the Haiphong Sea-Port waters, the placing of fishing traps/ nets of any other ways of catching marine products must be permitted by the Director of the Port Authority of Haiphong.
Section E: Specific Cases of Navigation
in the Sea-Port Waters.

Article 22:
All sea-going ships of 70 metres or more in length, when maneuvering for berthing, unberthing, turning in the Haiphong sea-port waters are compulsory to tugboat service employment.

Article 23:
In normal conditions, tugboat service employment is stipulated as follows:
a. For each vessel of 70 metres to 100 metres in length, one tugboat having power of no less than 375 KW (500 HP) is required.
b. For each vessel of 100 metres to 140 metres in length, two tugboats, one of which having power from 750 kw (1000HP) or more and the other having power from 375 kw (500 HP) or more is required.
c. If the vessel is fitted with thrusters, then the shipmaster may request the Director of the Port Authority of Haiphong for exemption of one tugboat service.

Article 24:
In the abnormal weather conditions (Wind-force from four (4) beaufort scale or more, or high-flood etc.) tugboat service employment is stipulated as follows:
a. For each vessel of 70 metres to 100 metres in length, two tugboats, one of which having power of no less than 375 kw (500 HP) is required.
b. For each vessel of 100 metres to 140 metres in length, two tugboats, each having power from 750 kw (500 HP) or more are required.

Article 25:
The exceptions to the employment of tugboat services are stipulated as follows:
a. Ships of less than 70 metres in length are not required to employ tugboat services, however, the shipmaster (ship power or ship's agent) may request the tugboat services as stipulated in paragraph "a" of Article 24, if necessary.
b. For vessels having the restricted draught or the length exceeding 140 metres or the Deadweight exceeding 12,000, when maneuvering for turning or for leaving /entering ports, the shipmaster may request more tugboat services or for tugs that have powers greater than those stipulated in paragraph "b" of Article 24.
c. For the vessels mentioned in paragraph "b" of this Article, when turning or navigating in the fairways, the shipmaster may request tugboats having powers from 750 kw (1000HP) or more for assisting, or he, at the instructions of the Port Authority of Haiphong, is bound to order tugboats for assisting or escorting his vessel.

Section F: Anchoring, Docking, Mooring alongside.

Article 26:
At the wharves No. 5 and No. 7 of the central port and at Cuacam port, if there are two sea-going ships of 400 GRT or more mooring alongside in pairs, other ships big or small, may not moor alongside the outer one. In case of coming alongside for water / oil supply or for cargo handling, those ships' activities must be conducted and permitted by the Port Authority of Haiphong.

Article 27:
In the Haiphong Sea-Port waters, the berthed or anchored vessels, prior to carrying on repair work such as hammering, painting, welding, cutting or reapair of ship's main engine or steering, anchoring gear etc. a permit from the Port Authority of Haiphong must be obtained. In the application for this permit which must be submitted to the Procedures Section of the Port Authority of Haiphong, there must be a detailed description of the items to be repaired, the time needed for such work and the repairer's qualifications.

Article 28:
1. The sea-going ship repairer, prior to carrying out repair work onboard the ships berthed, anchored within the Haiphong Sea-Port waters, must show to the Port Authority of Haiphong the following documents and papers:
- Ship's order for the repair services.
- Shipmaster's application for the repair.
(signed, stamped by the shipmaster)
- The repairer's services /business registration certificate (photo copy).
- List of means and equipment employed for the repair work.
2. The means of water transportation employed exclusively for the repair work must also complete the procedures as other ships and may only moor alongside the other ships for the services upon obtaining a permit from the Port Authority of Haiphong.

Section G: Responsibilities of Port Enterprises.

Article 29:
The enterprises having quays and wharves located in the Haiphong Sea-Port waters must implement the following stipulations:
a. Frequently maintain the required safe conditions, such as: sufficient fenders, competent criterions as designed of the quays, the required water depth at pier and in front of the wharves for ships entering / leaving / mooring to load/ unload cargo.
b. Investigate the waters in front of the wharves, the water depth at pier and deliver the chart on port water's depth to the Port Authority of Haiphong once every three months. If there is any unforeseen change of the port, the port managers must immediately notify the Port Authority of Haiphong.

Article 30:
1. Daily, the port enterprises must, at 8.00 hrs, send their plan of that day's conducting of ships, and at the latest at 16.00 hrs send the foreseen plan of the next day's conducting of ships to the Port Authority of Haiphong. (According to the tide, the latter may become a true plan or vice versa).
2. The port enterprises may themselves arrange the shifting of ships within one port, provide that the ship's main engine or tugboat services are not employed. If needed, they may request a shifting order from the Port Authority for such a shifting.

Article 31:
If cargo of other materials dropped into the pier or the fairways or the areas for lighterage, anchorage causing pollution or endanger the safety of ships, then , the port enterprises involved shall immediately notify the Port Authority of Haiphong and apply every required preventive measure. In the meantime, they must work out plans for recovering the sunken objects, clearing up the canal, and then give a notice of recovery result to the Port Authority of Haiphong.

Article 32:
The organizations having wharves employed exclusively for oil, petrol delivery / reception and those having floating yards, docks for repairing sea-going ships as well as those having bases for demolition of old ships must supply whereon with the equipment and tools for preventing environmental pollution (such as, the booms of spreading oil and chemicals, oil sludge tanks etc.)
These equipment must be assured in a state of readiness for employment and be placed at proper locations for response to an emergency.


Section H: Prevention of Fire, Explosions
and Environmental Pollution from Ships.

Article 33:
1. To remove, discharge wastes and residues as provided from ships, the shipmaster must apply for a permit from the Port Authority of Haiphong, and upon obtaining the permit, such activities may be carried out. The application letter is submitted to the Procedures Section of the Port Authority of Haiphong. Garbage and rubbish must be collected into containers, the removed by service organizations once every two days.
2. In the Haiphong Sea-Port waters, the garbagemen as well as facilities carrying out the services of waste collection and removal must correspondingly meet the requirements defined for the sanitary and environmental protection regulations.
3. The ship master is obliged to facilitate the service activities mentioned in paragraph "1" of this Article and pay the service costs, prior to the ship's departure.

Article 34:
Ships, while mooring at berths, are prohibited from carrying on the deratting or other fumigation work, unless they are permitted to by the Port Authority of Haiphong. Prior to the aforenamed work, the shipmaster must apply at the Port Authority of Haiphong for the exact anchoring positions at Bachdang, Ninhtiep, Halong (belonging to the Haiphong Sea-Port anchorage areas).
Right before and during the time of carrying on such work as deratting or neutralizing of poisons, warning signals must be displayed at locations visible to passers-by. In addition, precautionary measures must be taken to prevent environmental..., pollution of areas surrounding the ship.

Article 35:
During the time the ship is loading / unloading flammable or explosive cargo at the wharves, the shipmaster must request to have a fire-fighting station or fire-engine standing -by at the ship's side and he is liable for the payment of the costs incurred.

Article 36:
Oil tankers, while lying at wharves for delivering or receiving the first-class oil cargo must implement the following stipulations:
- Not to lie at anchor, where as to have ready all her fires and explosions-fighting for the proper response to an emergency.
- Pay out a steel cable from the bow and the other from the stern with its slack carefully arranged on deck, the inner end on the bitts and the loop end one metre (01m) above the surface of water, so that in the pressing circumstances, she may either be towed away or leave the wharf by herself at the instructions from the Port Authority of Haiphong in earliest possibility.

Article 37:
Oil tankers of 500 GRT or more, while lying at the wharves for cargo handling are strictly prohibited from carrying on any repairs of her main engine or anchoring / steering gear.

Section I: Loading, Unloading at Ports

Article 38:
1. For loading /unloading of cargo in the anchorage areas for lighterage, the shipmaster must arrange for the means of water transportation, lighters or other small ships safely mooring alongside his vessel. When coming alongside, they are required to employ firm, steady mooring lines, fenders and in throughout must constantly pay attention to general safety.
2. During the time the ship is loading / unloading cargo, the shipmaster must duly assign crew members to keep watches of the ship's draught to ensure safety. He is obliged to find a way to communicate with the Port Authority of Haiphong for relevant information for adjusting the ship's draught properly to conform to the channel's depth.

Article 39:
1. For ships being under cargo handling operations, the shipmasters together with the organizations or individuals involved must constantly maintain the required safe working conditions for the people, equipment and must immediately stop the aforesaid work if the safe working conditions are found inadequate.
2. It is everybody's obligation, while conducting cargo handling operations at ports, to care for and ensure the safety of ship as well as of facilities.

CHAPTER III
DEALING WITH INFRINGEMENTS.

Article 40:
Any infringement of the provisions stipulated in the present regulations shall be dealt with to the extent proposed in "the Regulations on the Management of Maritime Shipping Activities at Sea-Ports and in the Marine Navigable Zones of Vietnam" promulagated with Decree No. 13/CP dated 25 February 1994 by the Government.
